Default having been made in the payment of the debts and obligations secured to be paid by a
certain deed of trust executed by Kenneth Garrett, now deceased, and wife, Helen Dishman Garrett on the 23rd day of August, 2005, to Rusty Robbins, Trustee, as same appears of record in the
Register’s Office of Overton County, Tennessee, in Record Book 3, page 924, and Jim Evans having
been appointed Substitute Trustee per instrument recorded in Record Book 206, page 268; and First
National Bank of Tennessee being the owner and holder of the debt secured, having requested the
undersigned to advertise and sell the property described in and conveyed by the said deed of trust,
all of the said indebtedness having matured by default in the payment of a part thereof, this is to
give notice that the undersigned will on July 10th, 2019 commencing at 11:00 a.m., at the
east door of the Overton County Courthouse, Livingston, Tennessee, proceed to sell at
public outcry to the highest and best bidder for cash, the following described tract of property, to-wit:
Lying and being in the 6th CIVIL DISTRICT of Overton County, Tennessee bounded and described
as follows:
Tract 1: Located in the Good Hope Addition and being Lots Nos. 9, 10, 11 and Lots Nos.12, 48, 49,
50, and 51 in Block C, a plat of the Good Hope Addition being of record in WD Book 55, page 86,
Register’s Office, Overton County, Tennessee. Described in a deed by A.L. Bilbrey to Lacy Cantrell
and wife of record in the Register’s Office of Overton County, Tennessee, in Deed Book 75, page
332. There is excluded from the above one lot 100x100 foot square and now owned by Don White.
The previous and last conveyance being a Warranty Deed to Kenneth Garrett, recorded in the
Register’s Office of Overton County, Tennessee, in Warranty Deed Book 206, page 253.
For tax purposes, Tracts 1 and 2 being identified as Tax Map 54, Parcel 5.00.
Tract 2: Bounded on the North by the lands of Willis Johnson (now Tract 1 above); bounded
on the South by Clyde Norris; bounded on the East by White (now Coleman); and on the West by
Livingston-Jamestown highway, and being a portion of the lands conveyed to Thurman Warren from
Lacy Cantrell et ux, registered in Deed Book 89, page 532.
The previous and last conveyance being a Warranty Deed to Kenneth Garrett, recorded in the
Register’s Office of Overton County, Tennessee, in Book 201, page 562.
Exclusion: Being about 150 feet from highway at a stake, Garrett and Little line; running thence
Northwardly with Little’s line 100 feet to a stake; thence Eastwardly with Garrett line 100 feet to
a stake; thence Southwardly 100 feet with Garrett line to a stake; thence Westwardly 100 feet to
a stake, Little’s line. For tax purposes, Tracts 1 and 2 being identified as Tax Map 54, Parcel 5.00.
Tract 3: Beginning about 150 feet from highway at a stake, Garrett and Little line; running thence
Northwardly with Little’s line 100 feet to a stake; thence Eastwardly with Garrett line 100 feet to a
stake; thence Southwardly 100 feet with Garrett line to a stake; thence Westwardly 100 feet to a
stake, Little’s line.
The previous and last conveyance being a Warranty Deed to Kenneth Garrett, which deed is recorded in the Register’s Office of Overton County, Tennessee, in WD Book 188, page 270.
For tax purposes, being the property identified as Tax Map 54, Parcel 5.01.
The above described property has now been surveyed and the surveyed description is as follows:
Beginning at a steel post found in the Eastern right-of-way of the Jamestown Highway (S.R. 52)
and being the Southwest corner of the lands herein described and a corner of Potter; thence leaving
said right-of-way with the line of Potter North 37 degrees 25 minutes 21 seconds East 206.80 feet
to a steel post found and being a corner of Coleman; thence with the line of Coleman the following
calls; South 54 degrees 57 minutes 48 seconds East 99.72 feet to a ½ inch rebar set; North 36
degrees 43 minutes 29 seconds East 99.79 feet to an iron pipe found; South 54 degrees 16 minutes
55 seconds East 251.79 feet to a stone and being a corner of Norris; thence with Norris South 36
degrees 01 minutes 55 seconds West 316.28 feet to a ½ inch rebar set in the Eastern right-of-way
of the Jamestown Highway (S.R. 52); thence with the Eastern right-of-way of said road North 52
degrees 54 minutes 07 seconds West 357.78 feet to a steel post and being the point of beginning,
containing 2.31 acres more or less. This description taken from a survey and plat by David A. Sells,
RLS 1795, dated 8/15/05. This description and survey subject to any and all right-of-ways, easements, restrictions, and/or exceptions, recorded or unrecorded, which may affect this property.
The street address of the above-described property is believed to be 509 Jamestown Hwy., Livingston, TN 38570, (Map 054, Parcel 005.01 & 005.00) but such address is not
part of the legal description of the property sold herein and in the event of any discrepancy, the legal
description referenced herein shall control.
Said sale shall be subject to any unpaid property taxes, to any additional prior, liens, leases,
encumbrances, to any rights of redemption not heretofore expressly waived, and to all applicable
reservation of minerals, easements, rights-of-way, setback lines and restrictions.
OTHER INTERESTED PARTIES: Sherman Acquisition, as assignee of Sears holds judgment lien recorded in Record Book 6, page 196, Register’s Office, Overton County, Tennessee; North Star Capita
Acquisition, LLC holds a judgment lien recorded in Record Book 94, page 681, with an extension of
judgment lien recorded in Record Book 195, page 141; and Tenant(s) rights in possession, if any.
The equity of redemption, statutory right of redemption, homestead, curtesy and dower, appraisement, and the marshalling of liens and assets are waived in said deed of trust, and the title is
believed to be good, but the undersigned will sell and convey only such title as he may convey as
Trustee there being no representations or covenants of warranty of title made hereby.
It will be the responsibility of the successful bidder to obtain possession of the property at his
expense, and any damage, vandalism, theft, destruction, or other loss or damage to the property
occurring subsequent to the date of sale shall be at the risk of the successful bidder.
The Trustee reserves the right to postpone or set over the date of sale in the event the Trustee
deems it best for any reason at the time of sale to postpone or continue this sale from time to time,
with such notice of postponement as deemed reasonable by the Trustee. In the event the highest
bidder at such sale fails to complete his purchase of the subject real property within the applicable
time allowed, the undersigned Trustee reserves the right to complete the sale of the subject real
property, without further notice or advertisement, to the next highest bidder who is able to consummate his purchase of the property within the time permitted by the Trustee.
