Notice of Trustee's Sale


Notice is hereby given that on the 5th day of April, 2018, at the hour of 1:00 p.m., at the East entrance of the Overton County Courthouse, in Livingston, Tennessee, the undersigned Trustee, THOMAS A. WINDLE, by the terms of Deed(s) of Trust from RICHARD D. WILSON to THOMAS A. WINDLE, Trustee, dated August 29, 2013 and recorded September 16, 2013 @ 3:48 p.m. in Record Book 126, Page 303, in the Register’s Office for Overton County, Tennessee, by reason of default in the obligation secured thereby and performance of the covenants contained therein, including the breach or default, will sell to the highest bidder for cash the interest conveyed to the Trustee by said Deed(s) of Trust in and to the property hereinafter described.

The sale will be made without warranty as to title or encumbrances including unpaid taxes for the purpose of paying the obligations secured by the said Deed(s) of Trust, including charges and expenses of the Trustee, sums expended under the terms thereof, interest, attorneys’ fees, and the unpaid balance of the note secured thereby. This sale will be held in compliance with the terms of Section 35-5-101, et seq., Tennessee Code Annotated.

Said lands are described as follows, to-wit:

LYING AND BEING in the 8th Civil District of Overton County, and being more particularly described as follows:

BEGINNING at a set stone in the Hughie and Billy Oakley line where same is intersected by the line of Dennis Looper; thence in a Southerly direction with the Oakley line approximately 371 feet to the hollow; thence in a Westwardly direction with the Eugene Gilliam line and the hollow approximately 988 feet to a set stone with sugartree pointer in the Dennis Looper line; thence in a Northeastwardly direction with the Dennis Looper line to a hornbeam in the edge of branch; thence in an Eastwardly direction with the Dennis Looper line and fence to the point of BEGINNING, and being a portion of that property conveyed to Senter Oral Looper and wife Gladys Looper by deed of record in Book 137, Page 188, Register’s Office, Overton County, Tennessee.

The previous and last conveyance being a deed from Richard C. Wilson, surviving tenant by the entirety of Barbara J. Wilson, deceased, to Richard D. Wilson, of record in Record Book 122, Page 369, Register’s Office, Overton County, Tennessee.

Subject to off conveyance of 1.5 acres, of record in Warranty Deed Book 266, Page 550, Register’s Office, Overton County, Tennessee.

The property is located at 524 Pleasant Shade lane, Monterey, TN 38574

Interested parties defined by T.C.A Section 35-5-104(d):

1. Overton County Trustee

Information relating to all unpaid real property taxes due Overton County, Tennessee will be available on the date of sale

This sale is subject to rights of any existing tenants in accordance with the Protecting Tenants and Foreclosure Act of 2009, Section 701-704 Title VII, Public Law, 111-22.

This sale is being held in compliance with the provisions of the Deed of Trust as aforementioned and Section 35-5-101 et seq., Tennessee Code Annotated.
