NOTICE OF TRUSTEE’S SALE

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated April 16, 2013, and the Deed of Trust of even date securing the same, recorded April 18, 2013, in Book No. 119, at Page 928, and modified on April 27, 2017, In Book No. 166, At Page 457 in Office of the Register of Deeds for Overton County, Tennessee, executed by Brian E. McDonald and Sara Nicole McDonald, conveying certain property therein described to Charles E. Tonkin, II as Trustee for Mortgage Electronic Registration Systems, Inc., as nominee for Mortgage Investors Group, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by PennyMac Loan Services, LLC.

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by PennyMac Loan Services, LLC, will, on January 4, 2018 on or about 1:00 PM, at the Overton County Courthouse, Livingston, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Overton County, Tennessee, and being more particularly described as follows:

Located in the Sixth (6th) Civil District of Overton County, Tennessee, as follows:

Tract 1: Green Valley, Phase II, a 3.00 portion of Tract 35: Beginning at an iron pin located 55 feet East of the Southeastern most corner of Lot 34 and also being Southwestern most corner of Lot 36; thence with Tract 36, North 72 degrees 39 minutes 09 seconds East 151.92 feet to an iron pin and being the Southwest corner of Tract 37; thence with Tract 37, North 72 degrees 39 minutes 09 seconds East 154.68 feet to an iron pin and being the Southwest corner of Tract 38; thence with Tract 38, North 54 degrees 47 minutes 10 seconds East 378.87 feet to an iron pin and being the Northeast corner of the lands herein described; thence South 01 degrees 00 minutes 23 seconds East 373.22 feet to an iron pin and being the Southeast corner of the lands herein described; thence South 79 degrees 36 minutes 16 seconds West approximately 456 feet to an iron pin; thence severing the grantor in a Northwardly direction approximately 186.5 feet to an iron pin, the point of beginning, containing 3.00 acres, more or less. This description and survey subject to any and all rights of ways, easements, restrictions and/or exceptions, recorded or unrecorded, which may affect this property.

Said property is a portion of Green Valley Estates, Phase II.

Tract 2: Being Lot No. 38 of Green Valley Estates, Phase II, as shown on the plat of record in Plat Cabinet A, Map 151-A, in the Office of the Register of Deeds of Overton County, Tennessee, to which reference is here had.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose.
