WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated January 25, 2006, and the Deed of Trust of even date securing the same, recorded January 30, 2006, at Book 11, Page 355 in Office of the Register of Deeds for Overton County, Tennessee, executed by Lucille Barbour, conveying certain property therein described to Daniels & Giaimo, Attys. as Trustee for Mortgage Electronic Registration Systems, Inc., as nominee for Cumberland Mortgage & Loan Co., its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee.

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee will, on October 3, 2013 on or about 2:00 P.M., at the Overton County Courthouse, Livingston, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR CASH, free from the statutory right of redemption, homestead, dower, and all other exemptions which are expressly waived in the Deed of Trust, said property being real estate situated in Overton County, Tennessee, and being more particularly described as follows:

Lying and being in the 7th Civil District of Overton County, Tennessee and being more particularly described as follows, to wit:

Tract 1: Beginning at a mill (a) rock; thence South running with road 2-3/10ths chains to a rock on the side of a road going to Livingston; thence East through a field to a set stone 9 chains; thence Northwardly 3-8/10ths chains to Ramsey’s line to a stone; thence Westerly 7 chains with Ramsey’s line to Keisling’s corner; thence with Keisling’s line to the beginning corner, and containing 3-1/10ths acres, more or less.

Tract 2: Beginning at a Catalpa tree on the South bank of Livingston Road running South 100 feet with the road to a stone; thence bounded on the South by James Woddle a straight line 160 feet to a stone; thence Northeast 100 feet with Raines line; thence with Raines line 160 feet to the beginning corner, and containing 3/4 acre, more or less.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.
