DEFAULT having occurred in the performing terms of a promissory note described and secured by a Deed of Trust of record in Record Book 291, Page 450, Register’s Office for Overton County, Tennessee, and executed on the 12th day of October, 2001 by Jack Holtz conveying the propety therein described to Oakwood Acceptance Corporation, LLC. Said deed of trust having since been assigned to Vanderbilt Mortgage and Finance Inc , of record in Record Book 120, Page 59,Register’s Office for Overton County, Tennessee. Vanderbilt Mortgage and Finance, Inc. executed and Appointment of Substitute Trustee, naming R.N. “BO” TAYLOR as Substitute Trustee, which is of record in Record Book 120, Page 64 in the Register’s Office for Overton County, Tennessee.

And DEFAULT having been made in the promising terms of said Deed of Trust, which contains the power to sell upon default, the owner and holder, in accordance with the terms of said Deed of Trust, hereby declares the entire debt due and payable and demands that the said R.N. “BO” TAYLOR, Substitute Trustee, sell the property in accordance with said Deed of Trust.

THEREFORE, notice is hereby given that I, R.N. “BO” TAYLOR, SUBSTITUTE TRUSTEE, by virtue of the power and authority vested in me by said Deed of Trust, will on June 18, 2013 at 11:00 a.m. at the front door of the Courthouse in Livingston, Overton County, Tennessee, sell at public outcry to the highest bidder for cash, and free from the equity of redemption, homestead, dower and all other exemptions of every kind, all of which are expressly waived in said Deed of Trust, the following land in Overton County, Tennessee, described as follows:

Tract 13, Apachy Acres: Beginning at a ½ inch pipe on the West margin of Lonnie Nelson Lane being the Northeast corner of this tract and the Southeast corner of Tract Twelve; thence along the Lane South 4 deg. 31 min 53 sec. West 275.03 feet, South 12 deg. 49 min. 04 sec. East 50.40 feet, South 2 deg. 36 min. 42 sec. West 12.72 feet to a ½ inch pipe at the intersection of roads, leaving Nelson Lane North 82 deg. 27min. 12 sec. West 138.13 feet to a ½ inch pipe the Southwest corner of this Tract, North 1 deg. 26 min. 50 sec. East 323.16 feet to a 1/s inch pipe the Northwest corner of this Tract and the Southwest corner of Tract Twelve, South 87 deg. 52 min. 35 sec. East 140.00 feet to the point of beginning containing 1.0029 acres.

This being the same property conveyed to Jack Holtz from Thomas E. Spinks of record in Warranty Deed Book 298, Page 118, Register’s Office for Overton County, Tennessee.

The sale of this property is pursuant to Section 9-604 of the Uniform Commercial Code and Tennessee Annotated 47-9-604.

The sale of the above-described property shall be subject to all matters shown on any recorded plan; any unpaid taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; and any matter that an accurate survey of the premises might disclose. Said sale will be in bar of the right and equity of redemption, homestead and dower, but subject to all tax and prior liens of record in the Register’s Office for Overton County, Tennessee, which are applicable to this property and unpaid real estate taxes, if any.
