Notice is hereby given that on the 4th day of April 2013, at the hour of 1:00 p.m., at the East door of the Overton County Courthouse, in Livingston, Tennessee, the undersigned Successor Trustee, RANDY DODSON, designated as Successor Trustee by instrument dated March 7, 2013, and of record in Record Book 118, Page 407, Register’s Office, Overton County, Tennessee, by the terms of Deed(s) of Trust from HORACE LEE COX and NELLY COX to JACK WINDLE, TRUSTEE, dated March 8, 2003 and recorded on March 18, 2003 @ 1:30 p.m.. in Trust Book 320, Page 249, in the Register’s Office of Overton County, Tennessee, by reason of default in the obligation secured thereby and performance of the covenants contained therein, including the breach or default, will sell to the highest bidder for cash the interest conveyed to the Trustee by said Deed(s) of Trust in and to the property hereinafter described.

The sale will be made without warranty as to title or encumbrances including unpaid taxes for the purpose of paying the obligations secured by the said Deed(s) of Trust, including charges and expenses of the Trustee, sums expended under the terms thereof, interest, attorneys’ fees, and the unpaid balance of the note secured thereby. This sale will be held in compliance with the terms of Section 35-5-101, et seq., Tennessee Code Annotated.

Said lands are described as follows, to-wit:

LYING and being in the 5th (tax card) Civil District of Overton County, Tennessee, being more particularly described as follows, to-wit:

BEGINNING at a utility pole being the Northeast corner of the property being conveyed and being a corner of lands owned by Walker and by Vaughn; running Southwardly with Vaughn line 260 feet to the margin of the street; thence in a Westerly direction with margin of the street 150 feet to a corner with Qualls and Walker; thence Eastwardly 200 feet to the BEGINNING corner.

The previous and last conveyance being a deed from Arvis Johnson et ux Charlene Johnson to Horace Lee Cox et ux Nellie E. Cox, which deed is of record in Warranty Deed Book 191, Page 333, Register’s Office, Overton County, Tennessee.

Information relating to all unpaid real property taxes due Overton County, Tennessee will be available on the date of sale

This sale is being held in compliance with the provisions of the Deed of Trust as aforementioned and Section 35-5-101 et seq., Tennessee Code Annotated.
