WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated September 23, 2003, and the Deed of Trust of even date securing the same, recorded October 1, 2003, at Book 334, Page 339 in Office of the Register of Deeds for Overton County, Tennessee, executed by Eric L. Massie Sherry L. Massie Eric Massie and Sherry Massie , conveying certain property therein described to Tucker Harris as Trustee for CitiFinancial Mortgage Loan Corporation; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee.

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee will, on March 14, 2013 on or about 2:00 P.M., at the Overton County Courthouse, Livingston, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR CASH, free from the statutory right of redemption, homestead, dower, and all other exemptions which are expressly waived in the Deed of Trust, said property being real estate situated in Overton County, Tennessee, and being more particularly described as follows:

A certain tract or parcel of land lying and being in the 5th Civil District of Overton County, and being more fully described as follows:

Tract 1: Beginning at the Southeast corner of grantor’s property, being located on the Westerly side of Old Highway 42, thence Westwardly along the line of Qualls 200 feet, thence Northwardly 100 feet parallel with Old Highway 42, thence Eastwardly 200 feet to the right of way of old Highway 42, thence following the said right of way of Old Highway 42 Southerly 100 feet to the point of beginning, containing 0.46 acres, more or less.

Tract 2: Beginning on an iron pin in the West margin of Old Highway 42 and being 12 feet from the Southeast corner of Masters property, thence in a Westerly direction 318 feet to an iron pin in the property line of James H. Qualls; thence in a Northerly direction (referred to as a Southerly direction in prior deeds) 15 feet to an iron pin in the line of Masters, thence in an Easterly direction 318 feet to the margin of Old Highway 42, thence following the said margin of Old Highway 42, 12 feet in a Southerly direction to the point of beginning. Containing 0.11 acres, more or less.

The HB 3588 letter was mailed to the borrower(s) pursuant to Tennessee Code Annotated 35-5-117. This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.
