NOTICE OF TRUSTEE’S SALE AT PUBLIC AUCTION

Notice is hereby given that on the 5th day of September , 2013, at the hour of 1:00 p.m., at the East door of the Overton County Courthouse, in Livingston, Tennessee, the undersigned Trustee, THOMAS A. WINDLE, by the terms of Deed(s) of Trust from JANET DANN and ALAN DANN to THOMAS A. WINDLE, Trustee, dated February 9, 2010 and recorded February 18, 2010 @ 11:27 a.m. in Record Book 77, Pages 550-554, in the Register’s Office of Overton County, Tennessee, by reason of default in the obligation secured thereby and performance of the covenants contained therein, including the breach or default, will sell to the highest bidder for cash the interest conveyed to the Trustee by said Deed(s) of Trust in and to the property hereinafter described.

The sale will be made without warranty as to title or encumbrances including unpaid taxes for the purpose of paying the obligations secured by the said Deed(s) of Trust, including charges and expenses of the Trustee, sums expended under the terms thereof, interest, attorneys’ fees, and the unpaid balance of the note secured thereby. This sale will be held in compliance with the terms of Section 35-5-101, et seq., Tennessee Code Annotated.

Said lands are described as follows, to-wit:

LYING AND BEING in the 6th Civil District of Overton County, and being more particularly described as follows:

Beginning at a new iron rod on the North edge of College Street; thence South 83º24’ East 34.79 feet to an old iron rod; thence 84º06’ East 125.31 feet to a new iron rod; thence North 00º01’ East 271.13 feet to anew iron rod; thence North 82º05’ West 162.06 feet to an old concrete marker; thence South 00º08’ West 80.18 feet to an old wood post; thence South 00º27’ West 196.40 feet to a new iron rod, being the POINT OF BEGINNING, and CONTAINING one (1) acre.

Per surveyed Plat of Albert B. Sells, Tennessee Registered Land Surveyor No. 344, dated 12/26/94.

The previous and last conveyance being a deed from Curtis Lee wright, Delta Jo Wright, individually and as Power of Attorney of Douglas Duane Wright, as same appears of record in Record Book 31, Page 144, Register’s Office, Overton County, Tennessee. to Alan Dann et ux Janet Dann, of record in Record Book 31, Page 145, Register’s Office, Overton County, Tennessee.

Information relating to all unpaid real property taxes due Overton County, Tennessee will be available on the date of sale

This sale is subject to rights of any existing tenants in accordance with the Protecting Tenants and Foreclosure Act of 2009, Section 701-704 Title VII, Public Law, 111-22.

This sale is being held in compliance with the provisions of the Deed of Trust as aforementioned and Section 35-5-101 et seq., Tennessee Code Annotated.
