NOTICE OF TRUSTEE’S SALE AT PUBLIC AUCTION
Notice is hereby given that on the 29th day of August, 2013, at the hour of 1:00 p.m., at the East door of the Overton County Courthouse, in Livingston, Tennessee, the undersigned Trustee, THOMAS A. WINDLE, by the terms of Deed of Trust from RONALD J. WINNINGHAM and SHANNON REANAE EDMONDS
to THOMAS A. WINDLE, Trustee, dated October 19, 2007 and recorded November 2, 2007 @ 9:47 a.m. in Record Book 43, Page 46, and Deed of Trust from RONALD WINNINGHAM and SHANNON WINNINGHAM to THOMAS A. WINDLE, Trustee, dated October 28, 2008 and recorded November 17, 2008 @ 2:04 p.m. in Record Book 59, Page 109, and Deed of Trust from RONALD WINNINGHAM and SHANNON RENEA WINNINGHAM to THOMAS A. WINDLE, Trustee, dated December 18, 2010 and recorded December 23, 2010 @ 1:58 p.m. in Record Book 88, Page 925, respectively, in the Register’s Office of Overton County, Tennessee, by reason of default in the obligation secured thereby and performance of the covenants contained therein, including the breach or default, will sell to the highest bidder for cash the interest conveyed to the Trustee by said Deed(s) of Trust in and to the property hereinafter described.
The sale will be made without warranty as to title or encumbrances including unpaid taxes for the purpose of paying the obligations secured by the said Deed(s) of Trust, including charges and expenses of the Trustee, sums expended under the terms thereof, interest, attorneys’ fees, and the unpaid balance of the note secured thereby. This sale will be held in compliance with the terms of Section 35-5-101, et seq., Tennessee Code Annotated.
Said lands are described as follows, to-wit:
LYING AND BEING in the 11th Civil District of Overton County, and being more particularly described as follows:
Lying and being in the 11th Civil District of Overton County, Tennessee, and starting at the corner stone by Gunnels Cemetery take approximately 60 yards west to a red cement marker; thence tun south approximately 165 yards to a red cement marker; thence turn southeast approximately 45 yards to a corner stone; and finally turning north but slightly east approximately 180 yards to the corner stone back at the Gunnels Cemetery, and being a portion of the property heretofore conveyed by Warranty Deed unto Rick Winningham and wife Mary Jo Winningham, which deed is recorded in WD Book 236, Page 193.
The previous and last conveyance being a deed from Benjamin Winningham et ux Mandy L. Winningham to Ronald J. Winningham, of record in Warranty Deed Book 298, Page 705, Register’s Office, Overton County, Tennessee.
