NOTICE OF TRUSTEE’S SALE AT PUBLIC AUCTION
Notice is hereby given that on the 17th day of January , 2013, at the hour of 1:00 p.m., at the East door of the Overton County Courthouse, in Livingston, Tennessee, the undersigned Trustee, THOMAS A. WINDLE, by the terms of Deed(s) of Trust from JESSICA WHITE and RICHARD WADE WHITE
to THOMAS A. WINDLE, Trustee, dated November 9, 2007 and recorded November 26, 2007 @ 2:40 p.m. in Record Book 44, Pages 107-112, in the Register’s Office of Overton County, Tennessee, by reason of default in the obligation secured thereby and performance of the covenants contained therein, including the breach or default, will sell to the highest bidder for cash the interest conveyed to the Trustee by said Deed(s) of Trust in and to the property hereinafter described.
The sale will be made without warranty as to title or encumbrances including unpaid taxes for the purpose of paying the obligations secured by the said Deed(s) of Trust, including charges and expenses of the Trustee, sums expended under the terms thereof, interest, attorneys’ fees, and the unpaid balance of the note secured thereby. This sale will be held in compliance with the terms of Section 35-5-101, et seq., Tennessee Code Annotated.
Said lands are described as follows, to-wit:
LYING and being in the 11th Civil District of Overton County, Tennessee, more particularly described as follows:
BEGINNING at a stone in the C.C. Jones’ line, now owned by Johnnie Flowers; thence westwardly with the May Hue Smith line to the Phillips line at a stone on the side of the road; thence northwestwardly with a conditional line made by W.M. York and W.L. York to what is known as the Reagan Road to a rock; thence northeastwardly to a rock corner between the Jerry Holbert and W.L. York lands; thence eastwardly to the Thomas Hill spring branch; thence down said spring branch to a rock with white walnut pointers; thence eastwardly a straight line to a dogwood corner; thence southwardly with C.C. Jones’ line to the BEGINNING, and containing 50 acres more or less.
This being the same deed from W.M. Richardson to Clifton Wright registered in the Pickett County, Tennessee Register’s Office in Deed Book 10, page 189, and recorded in the Overton County Register’s Office in Deed Book 88, page 89.
This deed being dated September 26, 1945.
In case the timber is sold off said boundary of land, the proceeds of said sale is to be applied on the purchase monthly notes.
This EXCLUDES forty-eight(48) acres sold to Jimmy Sells et ux Sharon Sells in December of 1977, recorded in Deed Book 22, page 115, in Pickett County, Tennessee and in Deed Book 187, page 516, in Overton County, Tennessee. The two acres retained by us and conveyed in this warranty deed is all in Overton County, Tennessee.
The prior previous and last conveyance being a quitclaim deed from Shirley R.Wright et ux Betty L. Wright to Shirley R. Wright et ux Betty L. Wright, dated November 18, 1999 and recorded November 18, 1999 @ 1:40 p.m. in Warranty Deed Book 288, Page 609, Register’s Office, Overton County, Tennessee. NOTE: It appears that this deed was executed to revoke a trust. Further reference is had to Warranty Deed Book 195, Page 561 and Page 557.
Subject to Boundary Line Agreement of record in Warranty Deed Book 288, Page 613, Register’s Office, Overton County, Tennessee.
BEGINNING at an iron pin and a steel fence post at fence corner in the northeastern margin of the Clifton Wright Road, a corner of Sells; said point being located South 80º 11’ 17” East 847.82 feet from the intersection of the Howard Smith Road and the Clifton Wright Road; then leaving the northeastern margin of the Clifton Wright Road North 26º 38’ 58” East 337.41 to a steel fence post, a new corner of Sells; thence South 77º 13’ 16” East 260.46’ to a steel fence post, a new corner of Sells; thence South 25º 29’ 11” West, passing an axle at 317.25’, a total of 337.57’ to a point in the northeastern margin of the Clifton Wright Road, a corner of Sells; thence with the northeastern margin of Clifton Wright Road North 81º 57’ 49” West 51.10’; North 74º 51’ 20” West 126.13’; North 76º 44’ 44” West 90.14’ to the BEGINNING, and containing 2.00 acres, all bearings are magnetic and distances horizontal.
Surveyed in August, 1999, by Conrad E. Gernt, Tennessee Registered Land Surveyor No. 457, and being the same property which deed is recorded in Deed Book 191, page 688, in the Register’s Office of Overton County, Tennessee.
The previous and last conveyance being a deed from Shirley R. Wright et ux Betty L. Wright to Jessica White et vir Richard Wade White, of record in Record Book 43, Page 324, Register’s Office, Overton County, Tennessee.
Included is a 1978 SCHU 916 MH ID#E160644 which is situated on the lands described herein.
Any and all interest held by Richard Wade White was divested out of him and vested solely in Jessica L. White pursuant to a Final Decree of Divorce entered on April 1, 2011 and further filed of record in Record Book 115, Page 532, Register’s Office, Overton County, Tennessee.
Jessica L. White is now known as Jessica L. Goodman.
